Fesler USA, LLC – Terms and Conditions of Sale
I authorize FESLER USA, LLC (aka FLUSH MOUNT GLASS COMPANY, LLC) to take payment as per my selection at checkout for the total purchase amount in my cart. This authorization applies to the initial payment and any additional or recurring charges related to this transaction. All charges are final and non-refundable. By completing this purchase, I acknowledge that I am the authorized cardholder and waive my right to dispute payments with my financial institution or credit card provider, provided the transaction corresponds to the terms outlined below.
Terms of Purchase and Payment
1. Fitment Responsibility
Fesler USA assumes no responsibility for ensuring product fitment to your project or vehicle. It is the sole responsibility of the customer to verify that all parts ordered are compatible with their vehicle or project. No refunds, returns, or exchanges will be granted for products ordered incorrectly by the customer. All additional labor, modification, or supplementary purchases required to complete fitment are the sole responsibility of the customer.
2. Flush Mount Glass Test Fitment Requirement
All flush mount glass orders must be test-fitted to your vehicle within 60 days of receipt. Failure to conduct a test fit within this period forfeits your eligibility for fitment support or related assistance. This condition is absolute and non-negotiable.
3. Product Descriptions
Web descriptions provided by Fesler USA are general and for reference only. Each product or project is unique, and no product is advertised as a “universal fit” or “direct fit” solution. Customers acknowledge that descriptions are non-binding and individual results may vary.
4. Non-Refundable and Non-Returnable Items
All items, including but not limited to glass, upholstered items, aftermarket products, labor services, seating, Recaro products, and specialty orders, are non-refundable and non-returnable. These items are custom or made-to-order. No exceptions will be made, and returns will not be accepted under any circumstances.
5. Glass Shipments and Damage Claims
All glass sales are final. Damage claims must be reported immediately upon delivery. If glass arrives damaged, Fesler USA will replace it at no charge. Customers must accept all shipments and contact Fesler directly for replacement instructions. DO NOT refuse glass shipments for any reason. Refusing shipment will result in a $300 return/refusal fee per package or pallet.
6. Leather and Upholstery Variation
Leather grains, textures, and sheens vary from lot to lot. Fesler USA cannot guarantee exact matches to previous orders or samples. All upholstered sales are final. No returns, exchanges, or refunds will be permitted due to perceived material mismatches or dissatisfaction with color, texture, or finish. Customers are encouraged to consult with their representative before placing an order.
7. Modification Disclaimer
No Fesler product is guaranteed to fit without modification. Minor to moderate modifications may be required to achieve desired fitment. Customers acknowledge and accept that modifications are standard for many products. Fesler USA is not responsible for labor, tools, materials, or additional expenses incurred to modify products.
8. Shipping and Project Timelines
Shipping and production timelines are estimates only and subject to change. Delays may occur due to material shortages, staff limitations, machine breakdowns, supply chain issues, or other factors beyond our control. Shipping delays do not authorize cancellations, refunds, or returns. Custom orders will ship once all components are completed. Partial shipments are at the sole discretion of Fesler USA, and the customer will be notified in advance.
9. Chargeback Policy
Any chargeback issued against Fesler USA will result in immediate legal action. Fesler will pursue the full order amount, along with all legal fees, interest, and additional costs incurred during the dispute. Customers are responsible for all expenses related to chargebacks, regardless of the outcome.
10. Authorization and Deposit Charges
By proceeding with your purchase, you authorize Fesler USA to place a temporary authorization on your payment method to validate funds. This authorization is not a charge but may temporarily hold the funds for up to 7 days. Full payment will be processed upon shipment of your order. For deposits, 50% will be charged at the time of order, with the remaining 50% due prior to shipment.
11. Package Refusal and Return Fees
A $300 fee per package/pallet/crate will be charged for any refused shipment. Customers must inspect all packages immediately upon arrival and note any damage on the Bill of Lading (BOL) or shipping receipt. Damage must be reported to the delivery driver and to Fesler USA. Retain all packaging materials and contact us for further instructions.
Legal Provisions
• Governing Law: These terms are governed by the laws of the State of Arizona.
• Arbitration Clause: Any disputes arising from these terms or the sale of Fesler products shall be resolved through binding arbitration in Phoenix, Arizona, rather than litigation. The customer waives their right to participate in class-action lawsuits.
• Severability: If any provision of these terms is found to be unenforceable, the remainder of the terms will remain in full effect.
By completing this purchase, I confirm that I have read, understood, and agreed to the terms and conditions outlined above. I acknowledge that this purchase is final and non-refundable, waiving my right to dispute any charges related to this transaction.
